# Terms & Conditions

Welcome to **Kerala Diecast Cars**.
These Terms & Conditions govern your use of **keraladiecastcars.com** and purchases made from Kerala Diecast Cars. By accessing our website, placing an order, making a preorder, or purchasing from us, you agree to these Terms & Conditions.
## 1. General
Kerala Diecast Cars is a retailer of diecast models, collectibles, hobby products, RC vehicles and related products based in Kozhikode, Kerala, India.
We reserve the right to update our products, prices, offers, policies and these Terms & Conditions whenever reasonably necessary.
Any changes will apply from the date they are published on our website.
## 2. Product Information
We make reasonable efforts to ensure that product names, descriptions, specifications, images, scale, colours and prices displayed on our website are accurate.
However:
- Product colours may vary slightly depending on lighting, photography and display settings.
- Manufacturers may change packaging, accessories, specifications or minor product details without prior notice.
- Product images may sometimes be manufacturer or promotional images and may differ slightly from the final production model.
- Small paint variations, decals, panel alignment or other minor manufacturing variations can occur in mass-produced diecast models.
Such normal manufacturing variations will not automatically be considered damage or a defective product.
## 3. Collector Packaging
Many products sold by Kerala Diecast Cars are collectible items.
We make reasonable efforts to pack products securely. However, minor imperfections to outer packaging such as small bends, scratches, dents, corner wear or marks caused during manufacturing or transportation may occur.
Unless specifically advertised as **Mint Packaging**, the condition of the outer retail box or blister packaging is not guaranteed to be completely flawless.
Significant shipping damage will be handled according to our Refund / Replacement Policy.
## 4. Prices
All prices displayed on the website are in Indian Rupees (₹) unless stated otherwise.
Prices may change without prior notice.
Once an order has been successfully placed, we will normally honour the confirmed order price. However, if there is an obvious pricing, technical or listing error, Kerala Diecast Cars reserves the right to cancel the affected order and refund any amount paid.
Shipping charges, where applicable, will be displayed during checkout or communicated separately.
## 5. Orders
Placing an order does not guarantee acceptance of the order.
Orders are subject to:
- Stock availability
- Successful payment
- Payment verification
- Correct pricing
- Valid customer information
- Fraud and security checks
We reserve the right to cancel or refuse an order where reasonably necessary, including where stock is unavailable, incorrect pricing has been displayed, payment cannot be verified or fraudulent activity is suspected.
If Kerala Diecast Cars cancels an order after payment has been received, the applicable amount will be refunded.
## 6. Preorders
A **Preorder** allows customers to reserve a product before it arrives in our inventory.
The amount collected during preorder may be either:
- A partial advance amount; or
- The full product amount,
depending on the product listing.
The applicable amount will be shown when the preorder is placed.
### Estimated Arrival Date
Any ETA displayed for a preorder is an **estimated arrival period only** and is not a guaranteed delivery date.
Preorder shipments may be delayed because of circumstances including:
- Manufacturer delays
- Production delays
- International shipping delays
- Customs clearance
- Import procedures
- Port or logistics delays
- Supplier delays
- Transportation disruptions
- Circumstances outside our reasonable control
A change in the estimated arrival date does not automatically mean that the preorder has been cancelled.
We will provide updates where reasonably possible when significant ETA changes occur.
## 7. Preorder Balance Payment
Where only an advance amount has been collected, the remaining balance must be paid before the product can be dispatched.
Once the product arrives, customers may be contacted through WhatsApp, SMS, email or other contact information supplied with the order.
Customers must complete the remaining payment within the payment period communicated by Kerala Diecast Cars.
If the customer does not complete payment within the communicated period despite reasonable reminders, the reserved unit may be released for sale, subject to our applicable preorder/refund policy and applicable law.
## 8. Preorder Cancellation
Preorders are placed specifically to reserve incoming inventory.
Cancellation and refund eligibility for a preorder will therefore depend on the circumstances of the order and our Refund / Cancellation Policy.
Where Kerala Diecast Cars or the supplier is unable to fulfil a preorder, the customer will be offered the applicable refund or other available resolution.
Nothing in this section limits rights available to customers under applicable Indian consumer law.
## 9. In-Stock and Preorder Items
Preorder products and ready-stock products may need to be ordered separately.
Where our website prevents preorder and in-stock products from being purchased in the same cart, customers must place separate orders.
Each order may therefore have separate shipping and fulfilment timelines.
## 10. Payment
We accept payment methods displayed during checkout, which may include UPI, cards, net banking or other supported payment methods.
An order will normally be processed only after successful payment confirmation.
Kerala Diecast Cars is not responsible for delays caused by payment gateways, banks, UPI applications or payment service providers.
If payment is debited but the order is not confirmed, please contact us with the transaction details so that the payment can be verified.
## 11. Shipping
Orders are shipped according to our **Shipping Policy**.
Delivery estimates are approximate and may be affected by courier delays, weather conditions, holidays, remote delivery locations or other circumstances outside our control.
Once an order has been handed over to the courier, tracking information will be provided where available.
Customers are responsible for providing a complete and accurate:
- Name
- Mobile number
- Shipping address
- PIN code
- Other required delivery information
Kerala Diecast Cars will not be responsible for delivery delays, returns or additional shipping costs resulting from incorrect or incomplete information supplied by the customer.
## 12. Failed / Returned Deliveries
If an order is returned to us because of:
- Incorrect address
- Incorrect phone number
- Customer being unavailable
- Customer refusing delivery
- Repeated unsuccessful delivery attempts
the customer may be required to pay additional shipping charges before the order is dispatched again.
Any refund for returned shipments will be handled according to our Refund Policy and applicable law.
## 13. Damaged, Incorrect or Missing Products
Customers should inspect their parcel immediately after delivery.
For claims involving:
- Damaged products
- Wrong products
- Missing products
- Missing accessories
- Significant damage during shipping
a **clear and continuous unboxing video** showing the sealed parcel before opening and the complete unpacking process must be provided wherever reasonably required to establish the condition in which the parcel was received.
The video should clearly show:
1. The unopened parcel.
2. The shipping label.
3. All sides of the package.
4. The complete opening process without cuts.
5. The product and packaging.
6. The claimed damage, missing item or incorrect item.
Claims should be reported as soon as reasonably possible after delivery in accordance with our Refund / Replacement Policy.
Providing an unboxing video does not automatically guarantee a refund or replacement. The claim will be reviewed based on the circumstances and applicable consumer law.
## 14. Manufacturing Variations
Diecast models are mass-produced collectibles.
Minor variations may occur, including:
- Small paint imperfections
- Slight colour variation
- Minor decal placement differences
- Slight wheel alignment differences
- Minor panel gaps
- Small marks from manufacturing
- Minor packaging imperfections
Claims will be assessed based on the severity and nature of the issue.
Normal manufacturing tolerances or insignificant cosmetic variations may not qualify for replacement unless required under applicable law.
## 15. RC Cars and Electronic Products
RC cars, batteries, chargers and electronic accessories should be inspected and tested promptly after delivery.
Customers must follow the manufacturer's operating, charging and safety instructions.
Damage resulting from misuse, accidents, crashes, water exposure where the product is not designed for it, incorrect charging, modification, improper storage or normal wear and tear is not considered a manufacturing defect.
Any manufacturer warranty, where applicable, is subject to the manufacturer's warranty terms.
## 16. Order Modification
Once an order has entered packing, processing or shipping, we may not be able to modify:
- Products
- Variants
- Quantities
- Delivery addresses
- Contact information
Customers should contact us as quickly as possible if a change is required.
## 17. Offers, Discounts and Coupons
Discount codes and promotional offers:
- Cannot normally be exchanged for cash.
- May have specific validity periods.
- May apply only to selected products.
- May not be combinable with other offers.
- May be withdrawn or modified where reasonably necessary.
Any additional conditions shown with a promotion will form part of that promotion.
## 18. Reselling and Bulk Orders
Kerala Diecast Cars may limit quantities of certain limited-edition, high-demand or promotional products to ensure fair availability.
Large quantity or suspicious orders may be reviewed before acceptance.
Bulk, wholesale or reseller arrangements may have separate commercial terms.
## 19. Authenticity
We aim to sell products sourced through legitimate suppliers, distributors and import channels.
Brand names, logos and trademarks displayed on products remain the property of their respective trademark owners.
Kerala Diecast Cars is an independent retailer unless a product or brand relationship is specifically described otherwise.
## 20. Website Availability
We aim to keep the website available and accurate, but uninterrupted access cannot be guaranteed.
Temporary interruptions may occur because of:
- Maintenance
- Server problems
- Third-party services
- Payment gateway issues
- Internet failures
- Technical upgrades
We may temporarily restrict access to parts of the website where required for maintenance or security.
## 21. Intellectual Property
Unless otherwise stated, content created by Kerala Diecast Cars, including our:

- Original photographs
- Graphics
- Videos
- Product descriptions
- Promotional material

Third-party brand names, product photographs and trademarks remain the property of their respective owners.

## 25. Refunds and Replacements

These Terms & Conditions are governed by the applicable laws of India.
Any dispute will be handled in accordance with applicable Indian law and the jurisdictional rules governing consumer and other disputes.
Nothing in these Terms limits a customer's right to approach an appropriate consumer dispute redressal authority or other competent authority where permitted by law.
